The prominent role of the Center for Arbitration and Mediation of the Chamber of Commerce Brazil-Canada in the context of international commercial arbitration in Brazil is already well established, but its recognition will be enhanced by the fact that it will serve as the relevant set of rules to be applied in the 2017 edition of the Vis Moot Competition. The present commentary provides a detailed road map of the international arbitral process as contemplated from a Brazilian perspective and through the particular prism of the rules of Brazil’s pre-eminent arbitral institution. It thus provides the English reader with a valuable opportunity to consider how international arbitration is meant to function in Brazil. 2007 | 558 Pages | ISBN: 140513996X | PDF | 5 MB
The Arbitration Act 1996 radically changed English arbitration law in a number of respects. The effects of those changes are still developing and are being reflected in decisions of the courts. This section by section commentary on the Act, which Lord Bingham described as "intensely practical and admirably user-friendly" when it was first published, has been updated in a fourth edition which features comments on more than 125 new cases decided since the last edition was written in May 2003.As a result of these cases, and some changes to subsidiary legislation, the commentary on a great majority of the sections of Part 1 of the Act (the crucial part for most practitioners) has been amended, sometimes substantially. The book continues to provide checklists of choices which those involved in arbitrations need to consider, together with drafting suggestions and model agreements.Written by three practising arbitrators, this new edition continues to provide the most readable and useful guide to the Act. Arbitration Practice in Construction Contracts, Fifth Edition

Free Download Arbitration Practice in Construction Contracts, Fifth Edition By Douglas A. Stephenson(auth.)
2001 | 291 Pages | ISBN: 0632057416 | PDF | 5 MB
Since it came into force on 31 January 1997 the Arbitration Act 1996 has generally been welcomed by users and practitioners in the construction industry. It has fulfilled expectations that it would provide a user-friendly and practical basis of resolving disputes arising from construction contracts in a fair, expeditious and economical way. In doing so it has generated a modest volume of case law that has demonstrated the excellence of the Act’s provisions and its drafting. Since the Fourth Edition of this book appeared in 1997 the Housing Grants, Construction and Regeneration Act 1996 with its Scheme for Construction Contracts Regulations 1998 have come into force, as have the Civil Procedure Rules 1998, both of which affect the resolution of disputes arising from construction contracts. Case law has arisen from the Construction Act, and from the House of Lords’ judgment in the Beaufort Developments case, overturning the much-criticised judgment of the Court of Appeal in Crouch. In this Fifth Edition of an established text the author deals with each stage of an arbitration, explaining in practical terms the procedures to be adopted in avoiding disputes and in dealing with them efficiently when they do arise. It features over 20 specimen arbitration documents and includes the full text of the Act. It also covers several important developments in case law affecting construction arbitrations, and refers to the introduction and case law arising from adjudication under the Housing Grants, Construction and Regeneration Act 1996.Content: Chapter 1 Introduction (pages 1-13): Chapter 2 Arbitration Agreements (pages 14-38): Chapter 3 Appointment of the Arbitrator (pages 39-44): Chapter 4 Jurisdiction of the Arbitrator (pages 45-54): Chapter 5 The Preliminaries (pages 55-77): Chapter 6 Evidence (pages 78-85): Chapter 7 The Hearing (pages 86-93): Chapter 8 The Award (pages 94-110): Chapter 9 Costs (pages 111-119): Chapter 10 Powers of the Court in Relation to the Award (pages 120-124): Chapter 11 Dispute Avoidance and Management (pages 125-143):

The UNCITRAL Arbitration Rules A Commentary

Free Download The UNCITRAL Arbitration Rules: A Commentary By David D. Caron, Lee M. Caplan
2013 | 1048 Pages | ISBN: 0199696306 | EPUB | 19 MB
Reaching past the secrecy so often met in arbitration, the second edition of this commentary explains clearly and fully the workings of the UNCITRAL Rules of Arbitral Procedure recommended for use in 1976 by the United Nations. This new edition fully takes account of the revised Rules adopted in 2010 while maintaining coverage of the original Rules where these remain relevant. The differences between the old and the new Rules are clearly indicated and explained.Pulling together difficult to obtain sources from the Iran-United States Claims Tribunal, arbitrations under Chapter 11 of the North American Free Trade Agreement, and ad hoc arbitrations, it illuminates the shape the UNCITRAL Rules take in practice. The authors cogently critique that practice in the light of the negotiating history of the rules and solutions adopted by the other major private rules of arbitral procedure. To aid the specialist in the field, the practice of these various tribunals is extensively extracted and reproduced. Rich both in its analysis and sources, this text is indispensable for those working in or studying international arbitration.

Environmental Counterclaims in Investment Arbitration

Free Download Environmental Counterclaims in Investment Arbitration: Deconstructing the Requirements of Jurisdiction, Connection and Cause of Action by Andrés Eduardo Alvarado-Garzón
English | PDF PEUB (True) | 2023 | 331 Pages | ISBN : 3031463900 | 13.3 MB
This book critically analyses the availability of environmental counterclaims in investment arbitration presented by the respondent host state against the claimant investor. It starts from the premise that the conflicting relation between investment law and environmental protection cannot always be avoided. Yet, the instrument of environmental counterclaims in investment arbitration might alleviate such relation. Throughout its chapters, this book addresses the questions about the societal and practical relevance of seeking redress for environmental damage in investment arbitration, the functioning of such instrument both in contract-based and treaty-based investment arbitration, the suitability of arbitral tribunals to rule upon environmental issues, and the kind of environmental damages that could be redressed. Most importantly, by deconstructing the requirements of jurisdiction, connection between main claim and counterclaim, and cause of action, this book provides the tools for the re-conceptualisation of the instrument of counterclaims with the hope of harnessing its utility to achieve appropriate redress for environmental damages caused by foreign investors.
