What are the limits to criminalisation? Is insult harmful or just offensive? What is wrong with criminalising disrespect to state symbols? Should criminal codes be moral codes? Criminalising Harmful Conduct addresses the issue of legitimate criminalisation in a modern liberal society. It argues that criminalisation, as one of the most intrusive state interventions into the autonomous sphere of the individual, should be limited by normative principles, defining the substance of what can be legitimately proscribed. In part, it is a comparative study between two major criminal legal systems (its theories), the Anglo-American, on one side, and the Continental criminal legal system of Germanic legal circle, on the other. Moreover, the book explores a model structure of the ideal criminalisation in respect of the principles and other criteria that should be followed to render the outcome justifiable. The model’s central element is the Anglo-American principle called the ‘harm principle’, which is elaborated upon, its main elements (particularly ‘harm’) and functions analysed, and some controversial open questions tackled. Further limits on the harm principle are proposed. An in-depth analysis of four Continental legal concepts, which would on the face of it seem as counterparts to the harm principle, reveals that the overlap is not complete. The concept of ‘legal good’ shows the most potential and is thus examined in more detail. As it might be desirable to adopt the harm principle in the Continent, some practical ideas on how to achieve that are also mentioned.

This edited book explores how harmful speech works, how it can be used to change societies in bad ways and how we can defend against it. Harmful speech comes in a variety of forms, including hate speech, dehumanizing speech, misogynistic speech, derogatory speech, misgendering, marginalizing speech, and much more. What is common to all these types of speech is that they don’t just offend but seek to harm members of vulnerable groups, so that they feel humiliated, attacked, denigrated, silenced, and dehumanised. These harms are not confined to the conversation in which such speech is used, but may involve various downstream effects such as moral, social, and epistemic harms. Harmful speech may also shift social norms by changing people’s opinions and ultimately changing norms about how targets ought to be treated. Harmful speech uses this effect to establish and maintain oppressive norms, entrench hierarchies and shape power relations. The contributions in this volume examine the mechanisms underlying various forms of harmful speech and possible responses and remedies.

This book argues that when visual jokes are harmful, they harm in a specific way: a subject’s personhood is revoked in a way that differs both in kind and degree depending on whether that person is depicted or described. Such revocation can occur in every role and any stage within the joke’s context, from character to audience member, from moment of depiction to uncritical exposure. Unlike a mere unhumorous insult, which doesn’t require the sympathy of its audience but can operate solely between the target and the bully, a joke requires a particular kind of response from its audience to complete itself-to "deliver", which requires not only some degree of complicity from audience members, but a complicity earned at the expense of the joke’s referent. This book shows how we need not prevent the occurrence of these things in order to undermine their oppressive power-we only need the right kind of recontextualization: turning those utterances into jokes or turning those jokes against themselves. Unlike other forms of visual oppression, the harms contained within visual jokes can be reconfigured to affirm those they were created to harm, changing their function from jokes which attack others to jokes which attack themselves, empowering those they were created to target by calling into question the problematic conceptions of audiences who are sympathetic to the harmful joke’s initial formulation.
