Majority Rule or Minority Will Adherence to Precedent on the U.S. Supreme Court

Free Download Jeffrey A. Segal, "Majority Rule or Minority Will: Adherence to Precedent on the U.S. Supreme Court"
English | 2001 | pages: 357 | ISBN: 0521805716 | PDF | 8,7 mb
This book examines the influence of precedent on the behavior of the US Supreme Court justices throughout the Court’s history. Supreme Court justices almost always "follow" precedent, in that they always cite precedents for the positions they take. Because there are always precedents on either side of a case for justices to follow, following precedent does not mean that the justices are ever influenced by precedent. Employing the assumption that for precedent to be an influence on the behavior of justices, it must lead to a result they would not otherwise have reached, the authors show that precedent rarely controls the justices’ votes.

Minority Groups and Judicial Discourse in International Law A Comparative Perspective

Free Download Gaetano Pentassuglia, "Minority Groups and Judicial Discourse in International Law: A Comparative Perspective"
English | 2009 | pages: 305 | ISBN: 9004176721 | PDF | 1,4 mb
Set against previous stages of minority protection under international law, this book discusses the role of courts and court-like bodies – particularly in the Americas, Africa and Europe – in articulating and accommodating the interests and needs of ethno-cultural minority groups as part of the human rights discourse. Conceptually, it exposes different moments of intervention by such bodies involving the recognition of group existence or identity, the adjustment of human rights norms to accommodate the group’s perspectives, the establishment of processes designed to address the complexities resulting from competing claims, and the expansion of procedural avenues within litigation. The result is a fresh comparative – practical and theoretical – perspective on international jurisprudence as an emerging distinctive component in the complex history of the field.

Studying Ethnic Minority and Economically Disadvantaged Populations Methodological Challenges and Best Practices

Free Download George P Knight, "Studying Ethnic Minority and Economically Disadvantaged Populations: Methodological Challenges and Best Practices"
English | ISBN: 1433804743 | 2009 | 224 pages | PDF | 3 MB
Ethnic minority and economically disadvantaged populations have been historically underrepresented in social science research, and despite improvements in recent years, this trend continues today. Given the rapidly changing demographics of the United States, there is an acute need for more targeted research on these populations, which requires an understanding of diversity and a more nuanced understanding of human behavior and outcomes. Unfortunately, there is a relative dearth of information in standard research texts regarding the unique methodological challenges associated with conducting research with these populations. George P. Knight, Mark W. Roosa, and Adriana J. Uma a-Taylor have filled that gap with a book that identifies strategies for overcoming the obstacles social scientists routinely face in these situations. In this volume, the authors: Discuss strategies for resolving typical problems in sampling, recruitment and retention; Address ethical issues associated with researching these populations; Examine issues associated with measurement and the importance of measurement equivalence; Describe potential linguistic problems with translated measures and provide solutions to maintain the credibility of scientific inferences based on those measures, and; Present strategies for adapting previously published preventive interventions for use with ethnic minority and low-income populations. Throughout, the authors combine firsthand experience with a thorough and incisive understanding of the literature. The result is a vital, comprehensive resource that will be a great help for students and experienced researchers alike.
