Judicial Review in an Objective Legal System

Free Download Tara Smith, "Judicial Review in an Objective Legal System"
English | ISBN: 1107114497 | 2015 | 302 pages | AZW3 | 981 KB
How should courts interpret the law? While all agree that courts must be objective, people differ sharply over what this demands in practice: fidelity to the text? To the will of the people? To certain moral ideals? In Judicial Review in an Objective Legal System, Tara Smith breaks through the false dichotomies inherent in dominant theories – various forms of Originalism, Living Constitutionalism, and Minimalism – to present a new approach to judicial review. She contends that we cannot assess judicial review in isolation from the larger enterprise of which it is a part. By providing careful clarification of both the function of the legal system as well as of objectivity itself, she produces a compelling, firmly grounded account of genuinely objective judicial review. Smith’s innovative approach marks a welcome advance for anyone interested in legal objectivity and individual rights.

The Architecture of Nothingness An Explanation of the Objective Basis of Beauty in Architecture and the Arts

Free Download Frank Lyons, "The Architecture of Nothingness: An Explanation of the Objective Basis of Beauty in Architecture and the Arts"
English | 2019 | pages: 264 | ISBN: 1138214159, 1138214124 | PDF | 10,8 mb
It is a common enough assumption that good buildings make us feel good just as poor ones can make us feel insecure, depressed or even threatened. We may instantly decide that we ‘like’ one building more than another, in the same way that without thinking we choose one work of art or music over another. But what is going on when we make these instant decisions? The process is so complex that it remains an area rarely examined, often considered unfathomable, or for some mysterious, bordering even on the spiritual. Frank Lyons seeks to unpick the complex relationships that go to make up great works of architecture, to reveal a set of principles that are found to apply not only to architecture but also to art, music and culture in general. One of the major complications at the heart of culture is that because the arts are generated subjectively, it is assumed that the finished cultural artefact is also subjective. This is a myth that this book seeks to dispel. The arts are indeed created from the personal subjective space of an individual but what that individual has to say will only be shareable if expressed in coherent (objective) form.

Handbook on Legal Methodology From Objective to Method

English | ISBN: 1780686730 | 2018 | 98 pages | PDF | 1438 KB
Legal scholarship is one of the oldest academic disciplines, and the study of law has been passed on from generation to generation as an implicit "savoir faire". It was presumed that all legal scholars understood the methodology of legal research, making its explicit clarification and justification unnecessary. Over the last decade, the lack of an explicit methodological tradition has become problematic due to the growing interdisciplinary collaboration at universities and the increased importance of external funding, often granted by mixed experts panels. It is therefore time for legal scholarship to make its implicit methodology explicit. This handbook -created on the basis of a PhD project defended at KU Leuven Law Faculty in 2016 – carefully describes the methodology of traditional legal research in four sections:- First, the different types of research objectives that legal scholars can pursue are clarified.- Secondly, as each type of research objective calls for its own methodology, their methodological features are discussed individually.- Thirdly, after looking into each research objective separately, three overall methodological features applicable to all are addressed.- Fourthly, the theory of the previous parts is transformed into a practical methodological guide. This guide serves as a useful instrument for legal scholars who aim to design or reflect on research projects.
